About This Notice

This page explains how the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") applies to your use of the Service operated by One Reserve LLC ("One Reserve").

One Reserve Is Not a HIPAA Covered Entity

One Reserve provides the technology platform you use to access telehealth services. One Reserve is not a "covered entity" under HIPAA. Information you provide to One Reserve for purposes of creating and maintaining your account — such as your name, email address, shipping address, and phone number — is not "protected health information" under HIPAA.

However, in connection with the medical services you receive through the Service, you may share information that is protected under HIPAA or under applicable state privacy laws. That information is governed by your Medical Group's Notice of Privacy Practices, not this page.

Your Medical Group's Notice of Privacy Practices

The Medical Groups and Providers who deliver medical services through the Service are separate from One Reserve. They have adopted their own Notice of Privacy Practices ("Notice of Privacy Practices" or "NPP") that describes how they collect, use, and disclose your protected health information.

You receive the Medical Group's Notice of Privacy Practices when you create your patient account and complete your first medical consultation through the Service. By accessing or using any part of the Service, you acknowledge receipt of the Notice of Privacy Practices from your Medical Group and Provider(s).

If you have questions about the Medical Group's Notice of Privacy Practices, or you need a copy, please contact your Medical Group through the patient portal or contact us at support@onereserve.com and we will help you obtain one.

One Reserve as a Business Associate

In some cases, One Reserve may act as a "business associate" of a Medical Group or Pharmacy under HIPAA. In that role, One Reserve may receive, store, or transmit protected health information on behalf of the Medical Group or Pharmacy. When One Reserve acts as a business associate, it uses and discloses that information only in accordance with the applicable Business Associate Agreement and HIPAA.

What Is Protected Information

For purposes of this notice and the One Reserve Privacy Policy, "Protected Information" includes:

"Protected health information" as defined by HIPAA, when applicable

Health or medical information that is subject to specific protections under applicable state laws

Protected Information does not include information that has been de-identified in accordance with HIPAA or applicable state laws.

State Privacy Laws

In addition to HIPAA, several states have laws that protect consumer health data outside of HIPAA. These laws may give you additional rights — including rights to access, correct, delete, and withdraw consent for the use of your consumer health data. For information about how One Reserve handles consumer health data under these state laws, please see our Consumer Health Data Privacy Policy.

Certain products available through the Platform require a valid prescription by a licensed healthcare provider. You will not be able to obtain a prescription product unless you have completed a consultation with one of the Providers, the Provider has determined the prescription product is appropriate for you, and the Provider has written a prescription.

We do not control or interfere with the practice of medicine by the Medical Groups or any Providers, each of whom is solely responsible for directing the medical care and/or treatment they provide to you. By accepting this Agreement, you acknowledge and agree that One Reserve is not a healthcare provider and that by using the Service, you are not entering into a doctor-patient or other healthcare provider-patient relationship with One Reserve. By using the Service, you may, however, be entering into a doctor-patient or other healthcare provider-patient relationship with the Medical Group and/or one or more Providers. Further, we do not control or interfere with any professional service provided by the Labs and Pharmacies, each of which is solely responsible for their provision of professional services rendered via the Service.

FDA approval applies to each medication's indicated use as approved by the Food and Drug Administration. If compounded formulations are offered, please note that compounded medications are not FDA-approved as finished drug products and are prepared by licensed compounding pharmacies.

One Reserve and the Medical Groups are not enrolled with, and are not participating providers with, any federal or state healthcare programs (i.e., Medicare, Medicaid) or commercial payers for the provision of any healthcare services or supplies and, as such, neither you nor One Reserve or the Medical Groups may receive payment from such programs or payers for the services or products provided to you by One Reserve or the Medical Groups. Further, to the extent that any of the Labs, Pharmacies, or Providers may be enrolled in federal or state healthcare programs, the focus of certain services and products on wellness, health education, and prevention and the means through which the services and products are provided or made accessible through the Service typically precludes such services and products from being covered benefits under these programs. By choosing to use the Service, you are specifically choosing to obtain products and services on a cash basis outside of any federal or state healthcare program or commercial payer. Thus, you are solely responsible for the costs of any service or product provided to you.

One Reserve is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, “HIPAA”). One or more of the Labs, Pharmacies, or Medical Groups may or may not be a “covered entity” or “business associate” under HIPAA, and One Reserve may in some cases be a “business associate” of a Lab, Pharmacy, or Medical Group.

One Reserve is the technology platform. The medical providers are licensed physicians and practitioners who operate through the platform. You are not in a doctor-patient relationship with One Reserve — you are in one with your provider.Prescription required. A licensed provider will review your information before any medication is prescribed.If eligible, your provider issues a prescription. It is dispensed by a licensed compounding pharmacy.
